Subject: Urgent Civil Rights Complaint – Racial Discrimination, Institutional Neglect, and Program Abuse in Minnesota
Dear Civil Rights Division,
I am writing to file a formal civil rights complaint against multiple state and local institutions in Minnesota—specifically the Minnesota Valley Action Council (MVAC)—for racial discrimination, denial of public services, medical neglect, and systemic abuse under programs funded and regulated by federal agencies.
Background of Discrimination and Abuse
From August to December 2023, I was left without heat or hot water in a home with toxic basement mold. I had submitted a timely and qualified application to MVAC for Energy Assistance Program (EAP) benefits, which are federally funded and state-administered. Instead of processing or denying my application, MVAC placed it in “indefinite status,” while demanding compliance with supplying illegal information to them as a racial hazing. I know this from using the program since the 90's and understanding the rules as well as confirming with Shannon in the attorney generals office that it was in fact illegal. They were asked to then deny the application "officially" which would allow me to apply again. Intentionally, they left the informally denied application submitted in summer, "processing" in the system through November 2023, to prevent another application from being submitted. This allowed disconnection on a qualified application in August and I remained in the moldy home until I was able to move which was not until December 5, 2025 and I have suffered with a chest infection and cough everyday since. Additionally, what appears to be cancer formed on my right foot within a year. Additionally, since last week there is pain in right chest that may indicate of cancer spreading. I cannot get medical treatment because the same racism and criminality is happening in the local clinics. They're literally killing me.
After repeated requests for action or cancellation of my application, MVAC refused to respond. This administrative abuse put my life in danger and was done with reckless disregard for my safety and wellbeing.
They have reoffended again. A qualified application was submitted to the state on March 6, 2025. The local agency contacted me via text message saying they rejected it immediately without processing and sent me an email to tell me how they want me to apply - they have no legal authority to dictate how I apply to the state program.
And I already submitted a qualified application, which they illegally refused to process.
I don't have to complete an application through the process preferred by a worker of the program as a racist attack to remove my dignity; when the program is already regulated and I am not in violation of that regulation the local agency is.
On March 6, 2025, I applied again and was once more denied, even though I met the program’s requirements the text the employee sent me was a lie. My application had again been informally rejected but kept open in the system making it impossible to reapply. This results impending disconnection without an application ever being processed when I am eligible, in need and have submitted an application.
This is not cancer or daily illness. This is stop of the ability to prepare or store food. This is death. This time. I am severely physically disabled. I have no transportation. There is no public transportation in the city or the next two cities over. My phone and computer being electronic, I will have no means to contact the outside world. They're about to kill me. This report is evidence of reaching out to Minnesota's regulators to stop this systematic abuse.
I am now facing imminent utility disconnection, which will cut off my access to heat, light, food storage, and phone service while I live in roach-infested housing, under the threat of sexual harassment, and in declining health. This repeated denial of benefits shows clear, unlawful discrimination and institutional retaliation.
Discriminatory Housing and Public Neglect
After being forced out of my previous home due to uninhabitable conditions, I moved into a unit owned by Don Klyberg, a known slumlord previously shut down in Minneapolis for severe violations. He relocated to a different jurisdiction and continued operating without consequence. His property manager, Rick Newmann, has sexually harassed me repeatedly, and this abuse is known to Klyberg and reported to local authorities, including the city inspector, police, city attorney, and city hall—none of whom took action. This level of neglect is not the standard response for white victims, and I believe I have been targeted and ignored because I am Black.
Medical Fraud, HIPAA Violations, and Denial of Care
In addition to housing and program abuse, I have experienced racial discrimination in the medical system:
I was charged $4,000 for an ambulance when I received no emergency medical treatment.
Medicaid was also fraudulently billed for services I never received.
One hospital violated my HIPAA rights, and I have audio recordings as proof.
Another clinic falsified documents, which I have in my possession.
Local healthcare systems, particularly Alina Health, blocked my access to care based on false records and racially biased practices.
Only after removing my name from their systems was I able to receive surgical treatment out of state, recover some health, and briefly return to work—after years of being held back by untreated medical conditions in Minnesota.
Systemic Obstruction and Federal Implications
This is not an isolated incident. The abuse I’ve endured is systemic and racially discriminatory—a violation of my civil rights under federal law, including:
Title VI of the Civil Rights Act (discrimination by federally funded programs)
Fair Housing Act
Section 1557 of the ACA (discrimination in healthcare)
Americans with Disabilities Act (ADA), as my medical condition has been ignored and used as a tool of denial
Constitutional violations of equal protection and due process
Every level of government—state, local, and program administrators—has failed to act on documented reports and complaints. I am being denied access to public services, housing protection, safety, and basic medical care on the basis of race, poverty status, and disability.
What I Am Requesting
Immediate investigation into MVAC and its handling of my 2023 and 2025 energy assistance applications.
DOJ review of discriminatory practices by public housing authorities and law enforcement in Minnesota.
DOJ inquiry into fraudulent medical billing and HIPAA violations by Minnesota healthcare providers.
Enforcement action to prevent utility disconnection while my complaints are being reviewed.
Civil rights accountability across state funded programs, including EAP, housing assistance, and healthcare.
Justice, restitution, and public acknowledgment for the harm done.
Why I’m Speaking Out
I have documentation, audio, and written evidence to support every part of this complaint. I’ve published these stories and shared them publicly because I believe transparency is the only protection left to victims when the systems in place refuse to act.
I am not only seeking justice for myself—I am demanding that the systems that hurt me be held accountable before more lives are destroyed.
